TERMS OF SERVICE

1. Acceptance of Terms

The following “Terms of Service” (hereinafter referred to as the “TOS” or “Agreement”) sets forth the terms and conditions. By hiring or engaging Conlow Heating & Cooling LLC ("we", "our", or "us") for construction services, you (“Client”, “you”) agree to be bound by these Terms of Service
("Terms"). If you do not agree, please do not use our services.

2. Services Provided

We provide heating, ventilation, and air conditioning (“HVAC”) services, including but not limited to:

Installation of HVAC systems, furnaces, heat pumps, and air conditioners, Maintenance and tune-ups, Diagnostic testing and system inspections, Emergency repair services, Replacement of parts and equipment, Indoor air quality products and related services

3. Scheduling & Appointments

Service appointments are scheduled based on availability. Clients must provide at least 24 hours’ notice for cancellations or rescheduling. Missed or same-day cancellations may be subject to a service fee.

4. Estimates & Payments

Estimates are provided in writing before services begin. Final costs may vary if additional work, parts, or unforeseen issues arise.

Payment is due upon completion of services, unless otherwise agreed in writing. We accept cash, credit/debit cards, and checks. Returned checks will incur a fee.

5. Client Responsibilities

Provide safe and reasonable access to the property and equipment.

Maintain a clean and hazard-free work area. Ensure that existing systems meet local code requirements before upgrades or repairs. You agree to: Provide clear access to the job site - Notify us of any known hazards or restrictions - Communicate openly and timely about any concerns

6. Warranties

Manufacturer warranties apply to all new equipment installed.

Conlow Heating & Cooling LLC provides a 60-day workmanship warranty on labor for repairs and installations, unless otherwise specified.

Warranty does not cover damage caused by misuse, neglect, lack of maintenance, natural disasters, or unauthorized modifications.

7. Liability

We are not liable for damages caused by pre-existing issues, defective parts, power surges, or improper use of equipment.

We are not responsible for losses due to delays outside our control (e.g., supply chain shortages, extreme weather, emergencies).

Our liability is limited to the amount paid for the specific service performed.

8. Termination

We reserve the right to refuse or terminate service if: Unsafe working conditions exist. The Client engages in abusive or unlawful behavior.

The Client fails to comply with payment terms.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the courts of Cape May County, NJ.

10. Dispute Resolution

Any disputes will first be attempted to be resolved through mediation. If unresolved, disputes shall be settled in a court of competent jurisdiction in State of New Jersey.
